Resident Pool Membership Application

1) THE POOL IS A TOTALLY SMOKE FREE ENVIRONMENT.

2) Photo i.d. must be presented at all times before entering the club. Membership may not be transferred, and membership will be revoked if used by any person other than the registered member.

3) Children under the age of 16 will not be admitted unless accompanied by an adult, who shall be responsible for their safety and proper conduct.

4) Management reserves the right to limit the number of members. Management shall have the right to expel a member for not following all rules including all CDC and NYC Board of Health rules. This includes wearing of Masks/Face Covering Where Required and Social Distancing at all times.

5) No soliciting of any kind.

6) Before entering the pool, all bathers must observe the sanitary regulations of the Health Department as may be posted by Management.

7) Use of pool when a lifeguard is not on duty is prohibited. Lifeguards have full authority to expel or discipline any violators of the pool regulations. Diving from sides of the pool is prohibited.

8) There is to be no sitting, standing, or diving off the ledge of the pools or blocking the steps leading into the pool.

9) Infants and toddlers must wear rubber pants over diapers at the kiddie pool. Children who wear diapers are not allowed in the main pool. Children 8 years and older are not allowed in the kiddie pool. Parents must remain inside the kiddie pool gate with the child.

10) Swimming and the use of all facilities, is at the individual’s own risk and responsibility. Management assumes no responsibility whatsoever for personal injury of any kind resulting directly or indirectly from the use of the facilities by any members.

11) Coolers must not exceed the approved size, and we reserve the right to inspect bags.

12) The use of a radio is restricted to headphones only.

13) Management reserves the right to close the pool and/or club for maintenance purposes, inclement weather, or to alter or change the hours of operation without notice.

14) Management is not responsible for any personal items. Any items left will be discarded daily.

15) There will be no refunds under any circumstances.

16) I understand that the use of the pool facilities is subject to all rules and regulations. The rules and regulations may be changed, amended or added to, at any time by Management. Any infraction of these rules or objectionable conduct, as now or hereafter in effect, shall subject the violator to disciplinary measures; such as suspension, loss of privileges or the revocation of membership without refund.

Acknowledgement, Assumption of the Risk,
and Waiver of Liability Agreement Relating
to Coronavirus/COVID-19 Exposure (“Agreement”)
as a Result of Using the WP Pool, Pool Deck,
Bathroom Facilities and Personal Property Located thereon (“Pool”)


COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state and local governments and their respective health agencies recommend social distancing. In many jurisdictions the congregation of large groups of people have been restricted.

WP and Elite Pool & Fitness Management, Inc. (“Elite”), the company WP contracted with to operate the Pool have put in place preventative measures to reduce the spread of COVID-19 at the Pool, including recommended guidance and protocols issued by the Centers for Disease Control, and New York State and New York City Health Departments (the “Protocols”). However, neither WP nor Elite can guarantee that you will not become infected with COVID-19. Further, by using the Pool you could increase your risk of contracting COVID-19.

By signing this Agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by using the Pool and/or coming into contact with others using or working at the Pool and that such exposure or infection may result in personal injury, illness, temporary or permanent disability, and/or death. I understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, WP, its managing agent Akam Associates, Inc. and Elite, their Board members, agents and employees and other residents and/or third parties (collectively the “Released Parties”).

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, illness, temporary or permanent disability, and/or death), as well as any other damage, loss, claim, liability, or expense of any kind that I may experience or incur in connection with my use of the Pool (collectively the “Claims”). I hereby release, covenant not to sue, discharge, and hold harmless the Released Parties, of and from the Claims. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of any of the Released Parties, whether a COVID-19 infection occurs before, during, or after use of the Pool.

I further agree and acknowledge that I am responsible for complying with the Protocols, including all of the Pool safety policies adopted by Elite, as the same may be revised from time to time.

I further agree that this Agreement shall be binding upon my heirs, executors, and administrators. Additionally if minor children for whom I am a parent or legal guardian utilize the Pool, this Agreement shall be deemed to cover them as well.
